Terms and Conditions of the eGO Real Estate E-mail solution
1. GENERAL CONDITIONS
The Term of the eGO Real Estate Email solution, which hereafter will be referred to as eGO Email solution, disciplines the terms and conditions for which eGO Real Estate, makes available to its customers, electronic email accounts and services for commercial use and aimed to the use of their activities and services related with Real Estate.
When accepting this terms and conditions, the user is automatically subscribing and accepting the terms and conditions below transcript. The terms and conditions can at any time be modified, without any previous notice, having in such a way to include the new version in webmail.egorealestate.com. The modifications will take effect from the date of serving of the new version, unless otherwise specified in these terms. The continuous use of eGO Email solution by the user, after the completion of any change in these Terms, means that it is in accordance with such modifications.
2. OBJECT
The object of the present conditions provides Email Accounts, by SMTP, POP3, IMAP and Webmail access, via eGO Real Estate to its users.
3. ACCESS CONDITIONS
To have access to the eGO Email Solution, the user must have subscribed the service through a service contract of the eGO Real Estate software.
After subscribing the service, each customer/ agency will have available Email accounts with the maximum size of 5 Gigabytes each.
The suspension or termination of the subscribed service, will lead to the extinguishing and consequent removal of the Email account(s) and electronic documents and stored files, associated to the customer/agency.
The absence of consultation of the mailbox for more than 180 days will lead to its cancellation and consequent removal of electronic documents and stored filed related with that account, the cancellation can be performed without notice.
The reactivation of an Email account is possible in the first 28 days after its removal and it does not imply the recovery of electronic documents and previous stored filed and in case it is possible to recover it, costs can be applied and charged to the user.
The maximum limit of each message received and sent by the eGO Email solution is 20 Megabytes.
The user must keep required equipment to access the eGO Email solution in perfect working conditions by taking all necessary security measures to protect its equipment, systems and files against unauthorized activity and invasions by other internet users.
After subscribing the eGO Email Solution, the user will receive a login and password which will be their identification to use the eGO Email solution service.
The password is considered personal and non-transferable, and is exclusively up to the user to make careful use and maintain the confidentiality of this information. The user will be responsible for all acts practised by the use of the login and password.
eGO Real Estate is not responsible for the loss of password or user login, being the user exclusively responsible for any damages proceeding from the improper use of them, even by authorized third parties. In case of loss or theft of the password, the user commits to immediately inform the eGO Real Estate’s Technical Assistance of this fact.
The necessary settings and support to use the eGO Email solution, will be provided by eGO Real Estate’s Technical Support, through the tech team. They will give the indication of the service connection data, wherein the configuration of the email accounts in the respective applications will be the customer’s responsibility.
Access to the eGO Email solution will be available uninterruptedly, except for interruptions to perform maintenances resulting of new implementations and/or corrections that are necessary to guarantee the proper functioning of the solution, fortuitous cases of major force and/or acts and omissions of third parties.
eGO Real Estate is not responsible for the webmail backups. In regards to this issue, we advise the user to make these backups.
EGO REAL ESTATE IS NOT RESPONSIBLE FOR ANY DAMAGES AND/ OR LOSSES RELATED WITH THE TERMS FORESEEN IN THE ITEM ABOVE, OR OF THOSE WHERE EGO REAL ESTATE HAS NOT EXCLUSIVELY CONCURRED FOR THE DAMAGE AND/ OR LOSS OF.
eGO Real Estate declines all liability for damages and losses of any nature that may result from the presence of viruses or other harmful elements in the contents that, in such a way, may alter and/or damage the physical and/or electronic system of the user’s equipment.
Until the moment where it is effectively communicated to the eGO Real Estate Technical Support, the user will assume all liability and responsibility of their acts and behaviour, answering also for the acts of third parties in its name, by means of the use of its name and/or its password, when applicable. The user commits to compensate eGO Real Estate for any costs, damages and losses arising from actions or omissions that violate the provisions included in the present Terms, allowing eGO Real Estate to unilaterally suspend the contracted service.
4. USER RULES OF CONDUCT
The user commits to use the eGO Email solution in compliance with the current law and with the conditions of the present Terms, as well as the specific rules of service use here provided by eGO Real Estate.
The user may not use the eGO Email solution for:
a) use the solution to participate in electoral campaigns, civic or social, and also to propagate information of electoral nature, whether of themselves or others;
b) discredit, offend, disturb other people's tranquillity, pursue, threaten or violate third parties rights in any form;
c) publish, post, upload, distribute or display any topic, name, material or information that promotes discrimination, hatred or violence against a person or a group due to their race, religion or nationality;
d) use any material or information, including images or photographs on websites owned by eGO Real Estate, in order to infringe any copyrights, trademarks, patents, commercial secrets or other proprietary rights;
e) upload files that contain virus, Trojan horse, “worms”,” keyloggers”, “spyware”, clock-bombs, cancellation robots, corrupted files or any other similar software or program that can damage the operation of third parties computer or system;
f) send or forward warnings about computer viruses, since this task is the responsibility of eGO Email solution Systems Administrators;
g) counterfeit or delete any attributions to authors, legal notices or other adequate notices or assignments of property or labels of the origin or software source or other material contained in an uploaded file;
h) restrict or inhibit any other user from using and enjoying the service here available;
i) violate, by using the service, any code of conduct or other guidelines which may be applicable to any communication service;
j) violate, through the use of the solution, any laws or regulations;
k) create a false identity with the purpose of misleading others;
l) try to violate information security systems of third parties or private computer networks connected to the Internet;
m) use the solution to, in any way, reproduce or in any form infringe rights of third parties, such as images, audio, photographs, videos, software or any material protected by intellectual property laws, including, Authors’ Rights, brands or patents, unless the user has the necessary licenses to do so;
n) propagate, prompt or encourage pedophilia;
o) send collective email messages (Spam emails) to groups of users of this or other providers by offering products or services of any nature, their own or of others, other than the recipient’s interest or those that do not have the express consent of;
p) send email messages through the SMTP email server(s) of Janela Digital’s Internet system in ways that could compromise its normal performance, or be in conflict with the politics of its use;
eGO Email solution reserves the right to review at any time and without notice, on its own initiative or at the request of third parties, the content transmitted, spread out or made available to third parties by users through the solution and prevent their transmission, diffusion or making available to third parties in the cases where, in its agreement, have a contrary outcome to the General terms and conditions and legal notice.
In case of misuse or inappropriate use of the solution, eGO Real Estate may cancel the user’s access to the solution, at any time, with or without notice, by exclusive criteria of the eGO Real Estate Administration.
The user or users of eGO Email solution, who feel harmed by the receipt of not requested messages to a group of people, will be able to send a complaint via Email to support@egorealestate.com.
5. PRIVACY POLICY
eGO Real Estate has an express policy on the issue of user’s privacy. Personal Information and other user's information are subject to the treatment referred in the Privacy Policy.
6. INTELLECTUAL PROPERTY RIGHTS
The user acknowledges and agrees that the eGO Email solution, as well as the information, database and files contained in the websites property of eGO Real Estate and/or allow the user to have access and to use the personal account, represent confidential information and ownership of eGO Real Estate, which contain sensitive information and intellectual property, protected by international laws and author rights treaties.
The user expressly acknowledges that all rights and title to eGO Email solution, including associated intellectual property rights, will remain property of eGO Real Estate. The user agrees not to translate, decompile, copy, modify, reproduce, rent, publish, advertise, transmit, lend, distribute, re-sell, or in any other way make use of the eGO Email Solution or any part of the it. In addition, the user commits to not remove, occult or modify any patent notice, copyright or other proprietary right of the solution, as well as not remove or bypass any lock or security mechanism to restrict access and/or use of private material.
ANY NON-COMPLIANCE BY THE USER OF THE ARRANGEMENTS OF THE PRESENT TERM ENTAILS APPLICABLE CIVIL AND CRIMINAL SANCTIONS.
7. RESPONSIBILITY DISCLAIMER
The provided solution is intended for professional use for purposes expressly linked to the real estate activity. eGO Real Estate disclaims any and all responsibility for damages, including lost profits of any nature that may result from the attribution by users of any use or commercial purpose to the use of the solution.
8. GENERAL ARRANGEMENTS
The user may not transfer its rights or entrust to anyone the rights of this Term, being any attempt null, without previously having the written permission by eGO Real Estate.
In case of resolving that one or more arrangements of this Term is invalid, illegal or cannot be performed, the validity, legality and execution of the remaining arrangements will not be affected or prevented by this cause.
Changes that, by eGO Real Estate criterion, substantially affect the arrangements in the present Term, may only be implemented by notice sent to the user with 10 (ten) days in advance. Other changes will be considered applicable from the date of serving the new version in webmail.egorealestate.com being, therefore, the user’s responsibility to keep up to date in this regard.
Unless otherwise specified in these Terms, this agreement constitutes the integral agreement between the user and eGO Real Estate with regard to the service and substitutes any and all previous or current communication or proposal, either electronic, verbal or written, between the user and eGO Real Estate, with regards to the object of this Term.
